Kako je utvrđeno u Uredbi (EU) 2022/868 (Akt o upravljanju podacima), „zaštićeni podaci” odnose se na kategorije podataka zaštićene na temelju statističke povjerljivosti, poslovne tajne, prava intelektualnog vlasništva trećih strana i zaštite osobnih podataka. Ti se podaci mogu staviti na raspolaganje za ponovnu uporabu ako su ispunjeni određeni uvjeti i ako se poštuje zaštićeni status podataka. Ovaj katalog podataka služi kao jedinstvena informacijska točka na kojoj tijela javnog sektora mogu navesti „zaštićene podatke”, a potencijalni ponovni korisnici podataka mogu podnijeti zahtjev za podatke.
